And Mistakes are Not gonna get Cleaned Up because No One Admits to a Mistake. To wrongfully get the Innocent into a Guilty Plea. Publicly Admitting a Mistake occurred is Something most won’t allow to happen. Not Ever!

The American justice system, while designed to uphold fairness and impartiality, has occasionally fallen short of its ideals. The tragic reality is that innocent people have been convicted and imprisoned for crimes they did not commit. This paper will explore the factors that contribute to wrongful convictions, examine prominent cases, and propose reforms to prevent such injustices in the future.  

Common Causes of Wrongful Convictions

  • Eyewitness Misidentification: Often, eyewitness testimony is a crucial piece of evidence in criminal trials. However, studies have shown that eyewitness identifications can be remarkably unreliable, particularly when the perpetrator is a different race than the witness. You are so screwed!
  • False Confessions: Under duress, coercion, or misrepresentation of the law, innocent individuals may falsely confess to crimes they did not commit. This can be particularly problematic in cases involving juveniles or individuals with mental impairments.  You are so screwed!

  • Central Park Five: In 1989, five African American teenagers were wrongfully convicted of the rape and assault of a white woman in Central Park. They spent years in prison before being exonerated by DNA evidence in 2002.  
  • Ronald Cotton: Ronald Cotton was wrongfully convicted of rape in North Carolina in 1984 based on eyewitness misidentification. He spent 11 years in prison before being exonerated by DNA evidence in 1995.
  • Brendan Dassey: Brendan Dassey, a mentally challenged teenager, was wrongfully convicted of the murder of Teresa Halbach in Wisconsin in 2007. His conviction was overturned by the Wisconsin Supreme Court in 2016.

Several states have been identified as having higher rates of wrongful convictions. These states often share common factors, such as overburdened court systems, limited resources for defense attorneys, and a reliance on eyewitness testimony.
