Know Thy HEMP?

I’m 71 and I’m a Veteran. I saw Marijuana OVERSEAS. I tried it and enjoyed it’s soothing properties. But OVERSEAS and Retiring as a Texas Prison Guard, I came away with a good case of PTSD. And PTSD SUCKS. And thanks to the Texas Compassionate Use Program, last night, I slept for 6 hours non stop for six hours straight. The first time in over 40 years.

I usually get 1-2 hours of sleep between the most upsettling nightmares a person could ever have to endure. A living Hell. My own Hell. No one can feel it or endure it for me. So, I suffer incredibly. The blood spraying everywhere scenes. The Dying right in front of me. The knife Fights I broke up. Dang was I stupid full of testosterone.

But others suffer PTSD too. Police. Nurses. EMT. Doctors. Firefighters. Military Personnel. Prison Guards. OFFENDERS. And many millions more do too.

But now, I take a legal 5mg of THC in a gummy.

Just one 5mg THC gummy right before I go to sleep and that’s the only one.

I get no high feeling. Nothing like smoking Pot. Or that funny feeling I got OVERSEAS.

And I take Prozasin pill too. It’s for PTSD but doesn’t fully lock out nightmares.

But it helps. And PTSD makes you suffer badly and you make others suffer badly. It’s what PTSD does. Turn on people at the drop of a hat. Horrible turns of negative emotions upon others.

The pill works. I feel it calming my mind.

But now, I take a single 5mg THC gummy at night and one Prozasin. And two Tylenol and one Benadryl. I don’t drink and haven’t in 30 years.

But if I ever Hurt you, please accept this as my apology-I am sorry. I never meant for you to suffer the pain I am suffering.

The landscape of legal hemp and cannabis is undergoing a massive shift. The November 2026 Federal Hemp Ban closes what lawmakers refer to as the “2018 Farm Bill loophole”.

1. How We Got Here: The History & Legal Shift

The 2018 Farm Bill Loophole

When Congress passed the 2018 Farm Bill, it legalized hemp nationwide by defining it as any cannabis plant (or derivative) containing no more than 0.3% Delta-9 THC by dry weight.

However, the text specifically singled out Delta-9 THC rather than Total THC. Chemists and manufacturers quickly realized they could:

  • Harvest raw flower high in THC-A (which converts into Delta-9 THC when heated/smoked) and sell it as “hemp flower”.
  • Chemically convert natural CBD into intoxicating isomers like Delta-8 THC, Delta-10 THC, and HHC.
  • Concentrate small percentages of Delta-9 into high-potency gummies and beverages while remaining under the 0.3% dry-weight ratio.

This created an unregulated, multi-billion-dollar gray market operating out of smoke shops, gas stations, and online retailers nationwide.

The Federal Crackdown (Pub. L. No. 119-37)

In November 2025, federal legislation was signed containing Section 781, a provision specifically designed to eliminate psychoactive hemp products. It established a 1-year transition period, making the federal ban effective on November 12, 2026.

The new law introduces three primary changes:

  1. Total THC Standard: Testing must now calculate Total THC (Delta-9+THCA+Delta-8).
  2. Container Limits: Total THC in finished consumable hemp products is capped at 0.4 milligrams per container. (For context, a single standard cannabis gummy usually contains 5 mg to 10 mg of THC—meaning almost all edibles will become illegal).
  3. Synthetic Prohibition: Any cannabinoid synthesized outside the plant (such as Delta-8 derived from CBD isomerization) is banned outright.

Industrial hemp cultivated for fiber, grain, seeds, and research remains fully legal.

2. Impact on Texas & The Compassionate Use Program

The most crucial detail for patients is that the federal hemp ban will NOT destroy or restrict the Texas Compassionate Use Program (TCUP).

How Texas Pre-empted the Federal Ban

Texas did not wait for November 2026 to clamp down on over-the-counter hemp products:

  • September 2025 (SB 2024): Texas banned all hemp-derived vapes and e-cigarette products containing cannabinoids (including CBD).
  • March 31, 2026 (DSHS Rules & EO GA-56): State regulators banned retail sales of smokable hemp flower, pre-rolls, and THCA concentrates.

The Expansion of TCUP (HB 46)

While the retail hemp market faces heavy restrictions, Texas expanded its official medical cannabis program (TCUP) under HB 46:

  • Broader Qualifying Conditions: Added chronic pain, traumatic brain injury (TBI), Crohn’s disease, terminal illnesses, and a broad pathway for military veterans with debilitating conditions.
  • New Delivery Methods: Added non-smoking medical options such as medical vapes/inhalers, nebulizers, patches, and lotions alongside traditional tinctures and edibles.
  • Dispensary Growth: Authorized the Department of Public Safety (DPS) to issue up to 15 dispensing licenses and satellite locations across Texas health regions to improve patient access.

3. What to Watch Heading Into November 2026

  1. Federal Postponement Efforts: Bipartisan bills (such as H.R. 7024) have been introduced in Congress seeking to delay the effective date of the federal hemp ban from November 2026 to November 2028 to allow businesses time to offload inventory and transition.
  2. Shift to Medical: As grey-market smoke shop products vanish from Texas shelves, many consumers are transitioning into the state’s official TCUP medical program through registered physicians.
  3. State Court Challenges: Hemp industry trade groups in Texas continue to challenge state-level DSHS bans in court, though federal preemption will likely override state-level gray markets once the November 12 deadline arrives.
